The following agreement is by and between 100for100.com, a sub-unit of Singapore registered business H1Studio Pte Ltd located at 809 French Road #06-12 Singapore 200809 and the respective customer (now known as CUSTOMER) acquiring web hosting and related services from the former.

100for100 Web Hosting provides web hosting to many clients, and we have a responsibility to protect each client and to provide the best services available. When you abide by these guidelines, you help ensure that our obligations to you and our other customers are met.

General Issues

100for100 reserves the right to change this Policy any time, so please, check this page at least once a month or when in doubt. And we aim to provide businesses with the highest quality of hosting service, at the most competitive prices. The large number of clients we serve also makes it necessary for us to create such AUPs to ensure that all customers can enjoy the highest level of service quality possible.

The following policies apply to all domains residing on 100for100 servers. These include regular hosting clients, resellers, and their clients.

By submitting your online order and subscribing to 100for100's Web hosting and Internet-related services, you acknowledge that you have fully read and understood the terms and conditions stated in this agreement, and you agree to be bounded by these same terms and conditions. In this Agreement, "we" or "our" refers to 100for100, "client", "you", or "your" refers to the individual or company that makes use of service (s) provided by 100for100.

All information on this website is correct at time of publication. Data from the Web Server Speed Test and Price / Feature Comparison chart was extracted from the respective websites. Although we try to maintain the accuracy of the pricing, we hold no responsibility of any changes made after the information was posted on our site.

Unacceptable Content

All services provided by 100for100 Web Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any local laws governed by The Republic of Singapore, United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless 100for100 Web Hosting and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.

Our servers are located overseas so legally speaking, we are allowed to host adult content.

Examples of unacceptable content or links:

• Pirated software
• Hacker programs or archives
• Pirated MP3
• Warez / Pirated Mp3 / Pirated Mp3z sites
• Online Gaming Sites (Gambling, MUDs, Egg Drops or any type of interactive gaming)
• PhpNuke
• IRC or IRC Bots

100for100 Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Pornography and sex-related merchandising is allowed on all 100for100 Web Hosting servers. However, all models / actors / actresses must be ABOVE 18 years old. This includes sites that may infer sexual content, or link to adult content elsewhere. 100for100 Web Hosting will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content (child, rape, bestiality pornography etc) that may be damaging to 100for100 servers or any other server on the Internet. Links to such materials are also prohibited.

Beginning Oct 10, 2001, we will not allow any UBB or yaBB bulletin board systems to operate on our servers. These BB's are using flat files and put undue stress on the servers. For this reason , we will disallow these BB's to run on our servers.

Sites with banners, graphics or cgi's running from their domain used on other domains:
When you employ services such as Link Exchange or a cgi host who lets 1000's of others link to their site, it is important that you require any sites you exchange ads with to display your ad on their server. Not only will not abiding to this guideline cause your site to load slowly, you will be responsible for the data transfer used in this process.

Sites using more than 20% of system resources:
100for100 Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms & IRC:
We do not allow clients to install their own chat rooms. These tend to be a large drain on system resources and we cannot allow it as an account option. We currently do not allow IRC or IRC bots to be operated on our servers.

Email
Spamming, or the sending of unsolicited e-mail including, without limitation, commercial advertising and informational announcements, from an 100for100 Web Hosting server or using an e-mail address or domain that is maintained on an 100for100 Web Hosting machine as reference is STRICTLY prohibited. 100for100 Web Hosting will be the sole arbiter as to what constitutes a violation of this provision. A user shall not use another site's mail server to relay mail without the express permission of the site. 100for100 Web Hosting will be the sole arbiter as to what constitutes a violation of these provisions.

Free Template
All imagery, clipart and fonts used in the free templates are royalty-free and are the integral part of our products. One Time Usage License and Developers License give you the right to use images, clipart and fonts only as a part of the website you build using your template. You can use imagery, clipart and fonts to develop one project only. Any kind of separate usage or distribution is strictly prohibited. All images and illustrations used in templates come in a single layer, as is.

Server Abuse:
Any attempt to undermine, compromise the security of, or otherwise cause harm to any 100for100 Web Hosting server or customer accounts is strictly prohibited and will result in the cancellation of the account.

Background Running Programs:
We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Limited Liability
100for100 Web Hosting shall not be liable under any circumstances for any special, consequential, incidental or exemplary damages arising out of or in any way connected with 100for100 services, including but not limited to damages for lost profits, loss of use, lost data, down time, loss of privacy, damages to third party even if 100for100 has been advised of the possibility of such damages. The foregoing limitation of liability shall apply whether any claims based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose or otherwise.

100for100 Web Hosting will not censor any content on the INTERNET. It will be the Client's responsibility for the usage of his account and any consequences of this usage.

Money Back Guarantee
100for100 Web Hosting is pleased to offer a money-back guarantee within 7 days of your account activation should we fail to provide satisfactory service. Refund will take into account number of days used and a deduction of US$9 for domain name fixed cost for FREE domain accounts. Furthermore, 100for100 Web Hosting will not and can not be responsible for any fees that you charge for your services to your customers. Our guarantee does not apply to accounts which violate our acceptable use policies, exceed the data transfer limits, domain name registrations, or resold accounts.

Disclaimer:
100for100 Web Hosting cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by 100for100 Web Hosting are resold. Thus, certain equipment, routing, software, and programming used by 100for100 Web Hosting are not directly owned or written by 100for100 Web Hosting. Moreover, 100for100 Web Hosting holds no responsibility for the use / misuse of our clients accounts. We are not liable if any domain name is reported as the origination of Spam and subsequently blacklisted from Anti-Spam Organisations. We will be required, by law, to assist Anti-Spam investigations by authorities with provision of account details. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as 100for100 Web Hosting sees fit.

Account Activation
By activating your account with 100for100 Web Hosting, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer and a copy of your acceptance is forwarded along with your activation request to be maintained within your account information.

To reactivate a suspended account (due payment problems) a SG $50 reactivation fee must be paid for each suspended domain/account.

Established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via e-mail shortly after the online purchase has been made.

All payment is only accepted in US dollars / SG dollars.

Billing
Payments may be made via cheque, direct debit and credit card (Paypal). If you select to pay via credit card, your account will automatically be re-billed for future invoices unless you request otherwise.

Payment Fraud
All payment services are provided by the respective payment methods you choose. No confidential or security sensitive information is transferred to us when you use the Sign-up form. We will not be responsible for any fraud resulting from using these facilities. We only receive receipt numbers and payment confirmation.

Information Security Policy
100for100’s website has security measures in place to protect against the loss, misuse and alteration of the information. Our secure server encrypts all personal information (including name, address, credit card number and travel itinerary) so that it cannot be read as the information travels over the Internet.The advanced technology employed by 100for100 ensures all users that it virtually impossible for our users' credit card information to be used fraudulently.

Secure Socket Layer (SSL) Encryption
Industry standard security measures are used which is made available through your browser called Secure Socket Layer (SSL) encryption. As users enter the payment information, it is captured on a page that uses the SSL protocol by default. All personal and financial information is encrypted as it travels over the Internet. All financial information is stored in encrypted form on our servers. The server is also not accessible through the Internet.

Username and Password
All registered users are assigned a unique Username and Password to access information available on our website. Our servers have been designed to intelligently identify each user during the whole process. Other users will not be able to access the information from other computers.
